Welcome to FermaStat. These Terms of Use ("Terms") govern your access to and use of the FermaStat website, mobile apps, devices, and services (collectively, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old and capable of entering into a binding agreement to use FermaStat. By using our Services, you represent and warrant that you meet these requirements.

2. Accounts

  • You are responsible for maintaining the confidentiality of your account and password.
  • You agree to provide accurate and complete information when registering.
  • You are responsible for all activities that occur under your account.

3. Use of Services

You agree to use FermaStat only for lawful purposes and in compliance with these Terms. You must not:

  • Interfere with or disrupt the Services.
  • Attempt to gain unauthorized access to Fermastat systems.
  • Use FermaStat to monitor or control devices you do not own or have permission to access.
  • Reverse engineer, copy, or distribute any part of the Services without our consent.

4. Hardware and Data

  • FermaStat devices and sensors are designed to assist with fermentation monitoring, but you remain responsible for your brewing outcomes.
  • We do not guarantee error-free telemetry or that alerts will prevent product loss.
  • Data generated by your devices and accounts belongs to you, but you grant FermaStat a license to process, analyze, and display it for providing the Services.

5. Subscriptions and Payments

  • Certain features may require a paid subscription.
  • Fees are billed on a recurring basis as described at the time of purchase.
  • All payments are processed securely through third-party providers.
  • Subscriptions automatically renew unless canceled in your account settings.

6. Termination

We may suspend or terminate your account if you violate these Terms or misuse the Services. You may cancel your account at any time. Upon termination, your right to use the Services immediately ceases.

7. Intellectual Property

All FermaStat trademarks, logos, software, and content are owned by or licensed to us. You may not use them without our written permission.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, accurate, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law:

  • FermaStat shall not be liable for any indirect, incidental, special, or consequential damages.
  • Our total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless FermaStat, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of laws principles.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
